JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Goreakothi (Gautam Budh Nagar) P.S. Case No. 179 of 2013 registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

Taking into consideration that there is specific allegation of defalcation against the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Goreakothi (Gautam Budh Nagar) P.S. Case No. 179 of 2013 pending in the court of Chief Judicial Magistrate, Siwan stands rejected.

However, if petitioner surrenders before the

No.32169 of 2014 (2) dt.06-02-2015 concerned court within four weeks from the date of receipt/production of copy of this order and seeks regular bail with a proposal to deposit 50% of defalcated amount, the concerned court shall grant regular bail to the petitioner on the day of his surrender without being prejudiced by this rejection order.
