JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 379 and 215 of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act.

It is alleged that the bicycle of the brother-in-law of the informant was stolen, subsequently, the petitioner took `1,000/- for release of the bicycle but it was not released and when reminder was given, this petitioner fired. Though, no injury was caused to any one.

It is submitted by learned counsel for the petitioner that due to village politics, the accusation has been levelled and neither any injury was caused to anyone nor there is any proof with regard

Patna High Court Cr.Misc. No.21255 of 2015 (2) dt.20-05-2015 2/2 to payment to the petitioner. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Sikty P.S. Case No. 18 of 2014 pending in the court of learned JM, 1st Class, Araria. Accordingly, the application is disposed of.
