The petitioner apprehends his arrest in connection with Basopatti P.S. Case No. 201 of 2022 registered under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that from perusal of first information report itself, it is apparent that although the illicit liquor has been recovered from three motorcycles at the place of occurrence but the petitioner is neither owner of the motorcycle nor the alleged recovered material belongs to the petitioner.
