Petitioner, already in custody, seeks bail in connection with Jagdishpur P.S. Case No.202 of 2017 registered under Sections 420, 386, 341, 323, 504 and 506/34 of the Indian Penal Code. Allegation in brief is that the accused persons are not allowing to go over the purchased land of the informant and making demand of extortion money.
Learned counsel for the petitioner submits that in fact there is dispute relation to the land that one of the accused Rani Devi's father is the vendor of the informant who had sold another piece of land but mutation was made wrongfully by the informant with respect to the land he claims to have been in possession and against the mutation passed in favour of the informant, Rani Devi has preferred appeal before the DCLR, Bhagalpur vide Mutation Appeal No.71 of 2016-17 and that matter is still sub-judice and on account of
Patna High Court Cr.Misc. No.34397 of 2018(3) dt.28-06-2018 2/2 that false allegation of making demand of extortion money was made and Rani Devi has given power of attorney with respect to the same land to the petitioner; whereas learned counsel for the State opposes the prayer of bail and submits that this petitioner has large number of criminal antecedents.
Having considered the aforesaid facts and circumstances, petitioner Kuldeep Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Jagdishpur P.S. Case No.202 of 2017 with following conditions:
(1) If the petitioner is found indulged in future in similar offence, his bail bond shall liable to be cancelled.
(2) One of the bailors must be the close family member of the petitioner.
(2) The petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
