Patna High Court CWJC No.2533 of 2026(4) dt.29-07-2026 2/3 ORAL ORDER 29-07-2026 Mr. Naresh Dikshit, learned Special Public Prosecutor, on instructions, submits that though the petitioner appears to have deposited the challan amount with the Bank, the copy of the same has not been forwarded to the authorities so as to enable them to release the vehicle bearing Registration No. BR02GC-2166 along with Trailer bearing Registration No. BR02GC-3350 (in CWJC No. 2533 of 2026) and the vehicle bearing Registration No. BR01GF-3946 along with Trailer bearing Registration No. BR02GB-6366 (in CWJC No. 5462 of 2026). Learned counsel submits that in case the petitioner produce the challans paid before the Respondent No. 2, i.,e, the District Mining Officer, Gaya, the vehicle will be released immediately.

2. Having regard to the above made submission, the present writ petition is disposed of directing the petitioner to produce the challans evidencing the payment of the penalty before the Respondent No. 2, i.,e, the District Mining Officer, Gaya, before the Respondent No. 2 within a week from today. On such production, the Respondent No. 2, i.,e, the District Mining Officer, Gaya, shall release the vehicle bearing Registration No. BR02GC-2166 along with Trailer bearing Registration No. BR02GC-3350 (in CWJC No. 2533 of 2026)

Patna High Court CWJC No.2533 of 2026(4) dt.29-07-2026 3/3 and the vehicle bearing Registration No. BR01GF-3946 along with Trailer bearing Registration No. BR02GB-6366 (in CWJC No. 5462 of 2026).

3. It is needless to mention that the petitioner shall undertake not to alienate the vehicle or create any third party interest and will produce the vehicle before the authority as and when required.

4. With the above direction, both the writ petitions stand disposed of.
