JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 420,406,384,120B of the Indian Penal Code.

As per the prosecution story, two persons had negotiated with the informant for sale of Bolero vehicle. The accused persons are said to have taken a sum of Rs. 15,000/- as advance against the sale price for the said vehicle from the informant and at the time when the informant was trying to have test drive, one of the accused persons, claiming to be a police personnel told the informant that the vehicle was stolen one. The

The allegation is that thus, accused persons misappropriated the amount of Rs. 15,000/- fraudulently. Learned counsel for the petitioner submits that there is no allegation against the apetitioner that he took the money or influenced the informant in any manner to deliver the said amount It has been stated in paragraph 3 of the petition that the petitioner has no criminal antecedent.

In view of the above, the petitioner above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Pipra P.S. Case No. 246 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
