JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 379, 504 and 506 of the Indian Penal Code.
It is alleged that student leader Ramanand Yadav came at the room of the informant in the mid-night and on the point of pistol, snatched gold chain and on protest being made, he was assaulted by Ramanand Yadav, this petitioner and others with iron rod causing injury on the head and they also took away the laptop of the informant.
It is submitted by learned counsel for the petitioner that the accusation of assault is omnibus and general against all the accused persons and the injury report of the informant reflects
Patna High Court Cr.Misc. No.19649 of 2015 (3) dt.20-05-2015 2/2 only one injury, though opinion of the same has been kept reserved. There is counter version of the occurrence also and petitioner's side also received injury. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with M.U. P.S. Case No. 29 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
