The petitioners being the parents of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after five years of marriage for non-fulfillment of dowry demand by assaulting the victim and disposed of the dead body.
It is submitted by the learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family including the petitioners. The thrust of accusation is against the husband of the victim. The husband
Patna High Court Cr.Misc. No.20060 of 2016 (2) dt.05-05-2016 of the victim is in custody. The informant has retracted from the initial version and filed a petition to that effect before learned court below. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Patahi P.S. Case No. 194 of 2015, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) P.K./- U T
