This is an application for bail in connection with G.R.P. Biharsharif P.S. Case No. 10 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 353, 333, 379, 427, 436 of the Indian Penal Code, Section 27 of the Arms Act, Sections 3/4 of Prevention of Damage of Public Property Act and sections 145, 146, 147, 150 and 153 of Railway Act.
Allegation against the petitioner and others is of creating obstruction in discharge of official duty of the police and also of damaging the public property.
Submission of learned counsel for the petitioner is that he is not named in the FIR and except suspicion there is nothing against him and no specific allegation is attributed against him and he is in custody since 11.7.2017. Further submission is that other co-accused have been granted bail by this Court in
Patna High Court Cr.Misc. No.49054 of 2017 (2) dt.17-10-2017 2/2 Cr.Misc.No.42158 of 2017, vide order dated 12.9.2017. Heard learned APP also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Railway, Patna, in connection with G.R.P. Bihiarsharif P.S. Case No. 10 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date and on failure to appear on two consecutive dates without showing any genuine ground or without permission of court, his bail bond shall be cancelled.
