The petitioner seeks bail in anticipation of his arrest in connection with Cheriabariyarpur P.S. Case No. 2 of 2020, dated 02.01.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Though the petitioner has not been named in the F.I.R. and his implication in the present case is only on the basis of confession of a co-accused person and one such

No.14737 of 2020(2) dt.11-06-2020 2/2 similarly situated accused person has been granted anticipatory bail, I am not inclined to grant anticipatory bail to the petitioner in view of the fact that he has been made accused in three other cases of similar nature about which reference has been made in paragraph 3 of the bail petition. The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, if the petitioner surrenders before the Court below and seeks regular bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.

The application stands dismissed.
