Applicant has been arrested in connection with UdaKishunganj P.S. Case No.101 of 2017 for the offences under Sections-457/380 of I.P.C. He is in custody since 16.7.2017. Even though allegations for offence under Sections 457/380 of I.P.C. have been made, there has been no seizure of the stolen items from the applicant. The applicant was deputed to watch the house of the informant in his absence when he had gone with his wife to Pune on 6.6.2017. That being so, it is doubtful whether an offence for trespass is made out. In view of the facts and circumstances and the fact that the applicant has been in custody since 16.7.2017, the application is allowed.
