Petitioner, already in custody, seeks bail in connection with G.O. Case No. 04 of 2018 arising out of Baheri P.S. Case No.49 of 2018 registered under Sections 8/20 (b) (ii) (c), 25, 29 of the N.D.P.S. Act and 25 (1-b) a, 35 of the Arms Act. Allegation in brief is that one Chandan Kumar was apprehended by the police and 2 Kg Ganja was recovered from his poultry farm and he disclosed that he had kept two quintals of Ganja in the rented premises of the petitioner and accordingly, it was recovered.
Learned counsel for the petitioner submits that the recovery is not made from the possession of the petitioner rather the same was recovered from the rented premises by the accused
Patna High Court Cr.Misc. No.31870 of 2018(3) dt.19-07-2018 2/2 Chandan Kumar and he has been implicated only as he is the owner of the rented premises, but he had no knowledge of keeping Ganja and not connected in any manner with the said transaction and the petitioner has no criminal antecedent Having considered the aforesaid facts and circumstances, petitioner Raj Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Darbhanga in connection with G.O. Case No. 04 of 2018 arising out of Baheri P.S. Case No. 49 of 2018.
