JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 324, 307 and 504/34 of the Indian Penal Code.

It is alleged that while the informant was going by the motorcycle, he was intercepted by co-accused Bachcha Singh and Basist Singh when this petitioner assaulted the informant with Barchhi.

It is submitted by learned counsel for the petitioner that though, injury report suggest three injuries out of which one was found to be grievous but the witnesses have not supported the accusation against the petitioner and he was not sent up for trial but differing with the final form, cognizance was taken by the

Patna High Court Cr.Misc. No.21264 of 2015 (2) dt.20-05-2015 2/2 learned CJM vide order dated 02.09.2014. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Though, the accusation is specific against the petitioner in the FIR which is corroborated by the injury report but keeping in view of the fact that the petitioner was not sent up for trial, it is a fit case for consideration of regular bail if the petitioner surrenders within a period of six weeks in connection with Pakaridayal P.S. Case No. 68 of 2014 pending in the court of learned SDJM, Sikarhana at Motihari.

It expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same.

Accordingly, the application is disposed of.
