JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of killing the sister of the informant after ten years of the marriage by causing burnt injury and disposing the dead body.

It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled. During investigation, though, some of the witnesses have suggested that the victim committed suicide but some have suggested that the victim was raising alarm on the alleged date of occurrence and her dead body was disposed of.

Patna High Court Cr.Misc. No.31548 of 2014 (6) dt.01-04-2015 2/2 Considering the nature of accusation, this Court is not inclined to interfere.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Raxaul P.S. Case No. 327 of 2013 pending in the court of learned SDJM, Motihari, East Champaran. Accordingly, the application is disposed of.
