JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-04-2024 The present writ petition has been filed seeking the following reliefs:- "1. i) For issuance of a writ in the nature of Mandamus directing and commanding the respondents authority to pay "Assured Career Progression Scheme"(ACP) / "Modified Assured Career Progression Scheme" (MACP) from 04.11.1982 in place of 11.07.1984 though the petitioner joined his service on the post of Accounts

Patna High Court CWJC No.5276 of 2024(2) dt.18-04-2024 2/3 Clerk Social Security Services under the State of Bihar and Joined under Collectoriate Madhubani. Thereafter the petitioner vide letter No. 853 dated 09.07.1984 appointed on the post of Clerk and joined on 11.07.1984, since then working as a clerk.

ii) For issuance of an appropriate writ/writs, direction/ directions, order/orders to adjust all the date of payment of the ACP/MACP as per joining dated 04.11.1982 as other Accounts Clerk have been granted scale of Clerk and the petitioners also granted arrear of the period spent in the service of Account Clerk. The Account Clerks who have not been appointed on the post of clerk and continued on the same post of the Accounts Clerk are enjoying facilities of ACP since date of their joining. The petitioner is also entitled for the suitable interest over the hold amount."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Sitamarhi, for
