2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 323 , 467, 468 and 34 of the Indian Penal Code .
3 . As per the prosecution case , informant alleged that this petitioner sold the land of complainant to co-accused Vishnu Kumar and Krishna Kumar showing her dead.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.16686 of 2025(2) dt.16-04-2025 2/3 alleged date of occurrence is 01.11.2018 but the present complaint case has been lodged after of 2 years I. e , 17.08.2020 for which there is no explanation which itself creates the prosecution case doubtful. He next submits that from perusal of complaint, it is apparent that complainant is wife of one late Shyam lal Paswan . The name of wife of petitioner is Urmila Devi. After her death, petitioner executed sale deed of alleged piece of land to co-accused Vishnu Paswan and Krishna Kumar Paswan . The land is mutated and running in the name of this petitioner and as such petitioner has right title and possession over the land in question . The dispute is purely civil in nature . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, Araria in connection with Complaint case No. 954 of 2020, subject to the conditions laid down under section 438(2) of the
Patna High Court CR. MISC. No.16686 of 2025(2) dt.16-04-2025 3/3 Code of Criminal Procedure .
