The petitioner, in the present case, is seeking regular bail in connection with Barauni (Chakiya) P.S. Case No. 53 of 2018, registered for offences alleged under Sections 25 (1-b)a and 26 of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that when he was arrested by police one country made pistol and one live cartridge were recovered from his possession. It is submitted that petitioner has got no criminal history and the seizure list itself has been prepared illegally as there is no independent witness to the seizure list. Learned APP for the State is present and has
Patna High Court Cr.Misc. No.32345 of 2018 (2) dt.13-06-2018 2/2 opposed the prayer for bail.
Considering the submissions that the petitioner has no criminal antecedent and he is in custody since 16.02.2018, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Begusarai, in connection with Barauni (Chakiya) P.S. Case No. 53 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
