JUSTICE SATYAVRAT VERMA ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.02.2022, charge-sheet has been submitted in the case and has antecedent of three cases. Allegation is of recovery of 533.880 litres of liquor from a Bolero vehicle.

Learned counsel for the petitioner submits that neither the Bolero vehicle nor the recovered liquor belongs to the petitioner rather he had taken lift in the Bolero and came to be implicated when search was made.

Patna High Court CR. MISC. No.16769 of 2022(2) dt.08-04-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Hasanpur P.S. Case No. 31 of 2022 with a condition that one of the bailors of the petitioner shall be his father Upendra Yadav.
