The matter has been taken up through video conferencing.

The petitioner apprehends his arrest in Baikunthpur P.S. case No. 325/2019 registered under Section 272, 273/34 of the IPC and u/s 30(a) of the Bihar Prohibition & Excise Act. The police got secret information that Dilip Singh and Pramod Singh had stored liquor in the house of Masan Sai and on such raid was conducted and 37.350 liters of liquor was recovered. The police again got information and raided the house of Ravindra Singh and from the house of Ravindra Singh 48.750 liters of liquor was recovered. The name of petitioner transpired in the statement of Ravindra Singh who is said to have disclosed that petitioner used to supply liquor to him but

No.14359 of 2020(2) dt.12-06-2020 2/2 nothing has been recovered from the possession of the petitioner and save and except so called disclosure made by Ravindra Singh there is no material to show that petitioner ever supplied liquor to Ravindra Singh or he was found in possession of any quantity of liquor.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Gopalganj in connection with Baikunthpur P.S. case No. 325/2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
