JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 20-05-2015 Petitioner's writ application is dismissed for the reason that Vishwanath Pandey case was an exception and not a rule. The State Government has issued a notification contained in Annexure- 6 where the above fact has been clearly stated. This Court has already dealt with similar matters and after a detailed consideration has dismissed those writ applications. There is no reason why the present petitioner's claim will be treated differently.

Petitioner cannot derive any advantage of Vishwanath Pandey's case. His appointment has been made in terms of the

Patna High Court CWJC No.5372 of 2015 dt.20-05-2015 2/2 prevalent guidelines/ policy of compassionate appointment. Writ is dismissed.
