The petitioner seeks regular bail in connection with Sikandara P.S.Cae No.83 of 2017 registered for offences punishable under Section 273 of the Indian Penal Code and Section 30/30 (a) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is about recovery of 498 ltrs. of liquor from the Tata Sumo. Further, the petitioner is accused in similar type of case.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. He has remained in custody for about 3 months.

Heard learned A.P.P. also.

Having heard both sides and in view of allegation, this application is disposed of with direction that once the charge

Patna High Court Cr.Misc. No.44378 of 2017 (2) dt.15-09-2017 is framed or the petitioner completes total six months period in judicial custody, whichever is earlier, the learned court below shall release him in connection with Sikandara P.S.Case No.83 of 2017. With the aforesaid observation, this application is disposed of.
