14-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application has been filed for the grant of regular bail to the petitioner in connection with Ram Nagar P.S. Case No. 402/2017 for the offences punishable under Sections 366, 366A, 379, 506, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner happens to be the father of a boy Raju Ram against whom the allegation is that he had taken away the minor daughter of the informant. Learned counsel further submits that this petitioner has been involved in the present case only because he happens to be the father of the boy with whom the girl seems to have got some affairs and they are said to have married and are residing together.
Patna High Court Cr.Misc. No.32599 of 2018 (2) dt.14-06-2018 Learned counsel submits that this petitioner is in custody for about six months and similarly situated accused Bhadai Ram has already been granted privilege of regular bail by a co-ordinate Bench of this court in Cr. Misc. No. 11994/2018, vide Annexure-2 to the present application. Learned Additional Public Prosecutor for the State is present.
Considering the facts and circumstances of the case wherein it is stated that the petitioner is the father of Raju Ram with whom the daughter of the informant had allegedly gone away and further that the petitioner is in custody for over six months, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Ram Nagar P.S. Case No. 402/2017.
