JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the panchayat secretary is apprehending arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code. It is alleged the informant committed forgery of Rs.3600/- with regard to distribution of Oldman Pension Scheme, which was given to someone else in the name of the complainant Nasima Khatoon.
It is submitted by learned counsel for the petitioner that the distribution of the pension was made on proper identification and for the occurrence of the year 2013, the FIR has been registered in 2015. A statement has been made in paragraph 3 of
Patna High Court Cr.Misc. No.24859 of 2015 (2) dt.08-07-2015 2/2 the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Dalsing Sarai, Samastipur in connection with Dalsing Sarai P.S. Case No.1 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
