The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. Allegation against the accused persons including the petitioners is of assaulting the informant and his family members, on account of which informant's father sustained grievous injury.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.4.2017. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no allegation of assault alleged against the petitioner. Co-accused
Patna High Court Cr.Misc. No.42482 of 2017(2) dt.19-09-2017 2/2 Anoj Yadav is said to have assaulted the prosecution party. Other co-accused with similar allegation have been granted bail vide Annexure-3 to the present application.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. case No.377 of 2016.
