1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341 , 323, 324, 337, 338, 295a, 353, 153A, 427, 120B, 307, 504 and 506 of the Indian Penal Code .

3. As per the prosecution case, it is alleged that this petitioner along with other co-accused persons disturbed the peace and tranquility of the locality and their act led to communal tension. It is further alleged that they pelted stones and prevented the police officials from discharging their public duties.

4. It is submitted on behalf of the petitioner there is general and omnibus allegation against this petitioner and in the

Patna High Court CR. MISC. No.18707 of 2024(3) dt.19-04-2024 2/2 alleged occurrence no one sustained injury . Similarly situated co-accused persons have already granted bail by this Court vide order dated 16.10.2023 in Cr. Misc. No. 62704 of 2023 . Petitioner claims clean antecedents.

5. Learned counsel for the State vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judiial Magistrate 1st Class, Aurangabad/concerned court below in connection with Kutumba P. S. Case No. 184 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure .
