Petitioner is in custody in connection with Saharsa Rail P.S. Case No. 12 of 2018, for offenses punishable under section 30(a) of Bihar Excise Amendment Act 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

From the FIR it appears that 15 litrs of liquor was recovered from the trolley bag and in that connection, petitioner was arrested.

Learned counsel for the petitioner submits that trolley does not belong to the petitioner and he was arrested near railway station, only on the ground of suspicion, while he was waiting for his relative arrival.

No.32385 of 2018(2) dt.05-06-2018 2/2 Considering the fact that the petitioner has no criminal antecedent, and remained in custody since 16.04.2018, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IIIrd Cum Special Judge, Excise Khagariya, in connection with Saharsa Rail P.S. Case No. 12 of 2018.
