The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B, 201 and 34 of the Indian Penal Code.

As per the prosecution case, the sister of the informant who was married to this petitioner is stated to have been strangulated to death by this petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason of his being the husband of the deceased. The allegations are false and concocted. There are no eye witness to the occurrence. The relationship between the parties were absolutely cordial. The petitioner has small children and there is

Patna High Court CR. MISC. No. 26167 of 2021(4) dt.20-12-2021 2/2 no person to look after them. The petitioner is in custody since 24.5.2020 and has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the direct allegation against the petitioner who happens to be the husband of the deceased, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
