====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 420 of the IPC and 66 (C) of I.T. Act. The prosecution story, in brief, is that on 16.01.2019 at about 10-12 P.M., the informant received message of withdrawal of Rs. 10,000/- from her account on her registered mobile number, though A.T.M. Card was with her. Thereafter, Rs. 40,000/- was also withdrawn from her account. The informant made complain to the concerned Bank and also get locked her A.T.M. Card.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since

Patna High Court CR. MISC. No.14465 of 2020(2) dt.02-03-2020 2/2 13.12.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come in the present case on the basis of confessional statement of co-accused. Except for this, there is no substantive evidence to suggest the implication of the petitioner in the present case. Other co-accused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 72577 of 2019 under order dated 27.11.2019 annexed as Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-Ist Class, Araria, in connection with Forbesganj P.S. Case No. 174 of 2019.
