The petitioner, in the present case, is seeking regular bail in connection with Sheikhpura P.S. Case No.268 of 2018, registered for offences alleged under Sections 341, 323, 307 of the Indian Penal Code and further added Section 302 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the F.I.R is very specific about the manner of occurrence. According to the informant, one Babloo Kumar had assaulted the deceased on his head. It is submitted that only later on in order to falsely implicate the petitioner he made a different story and the manner of occurrence was developed. It is further submitted that the

Learned A.P.P for the State is present and opposes the bail application, however, he did not dispute the facts, as stated in the F.I.R, that the specific allegation of assault over the head of the deceased is not attributed to the petitioner. Considering the submissions that in the F.I.R the specific allegation is against accused Babloo Kumar and not against the petitioner and the petitioner has no criminal antecedents, let the petitioner, named above, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Sheikhpura, in connection with Sheikhpura P.S.
