This appeal under Section 14A(2) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been directed against the order dated 14.02.2020 passed by learned Additional Sessions Judge-1st, Khagaria in Beldaur P.S. Case No. 237 of 2019 registered under Sections 366A of the Indian Penal Code and Section 3(G) of SC/ST (POA) Act, whereby the prayer for bail of the appellant has been rejected. Learned counsel appearing for the appellant submits that the appellant is innocent and has not committed any offence. In fact, the parties have settled their dispute by way of compromise which is evident from Annexure-3 and the appellant is rotting in judicial custody since 14.02.2020. The appellant has no criminal history. Hence, the appellant may be

Considering the facts and circumstances of the case, let the above named appellant be released on bail on furnishing personal bail bond to the satisfaction of the learned Additional Sessions Judge-1st, Khagaria in connection with Beldaur P.S. Case No. 237 of 2019).

Accordingly, this appeal is allowed and the impugned order is set aside.
