2. The petitioners apprehend their arrest in connection with Dumariyaghat P.S. Case No. 118 of 2023 registered under Sections 366(A), 506 of the Indian Penal Code and Section 4/8 of POCSO Act.

3. As per prosecution case, these petitioners along with other named accused persons kidnapped the minor daughter of informant.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.18340 of 2024(4) dt.21-08-2024 2/3 petitioners submits that petitioners are innocent and have falsely been implicated in the present case merely because petitioners are father and mother of co-accused Ankit Kumar. Further submission is that the victim in her statement recorded under Section 164 Cr.P.C. has categorically stated that she is 18 years old and she on her own will had gone with co-accused Ankit Kumar to Punjab, where she solemnized marriage with him. Lastly, it is submitted that petitioners have got clean antecedent.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

Having considered the accusation and the statement of the victim recorded under Section 164 Cr.P.C., let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bailbonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum-Special Judge, POCSO, Motihari, East Champaran in connection with Dumariyaghat P.S.
