JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is of assaulting the informant and others in the background of land dispute.
It is submitted by learned counsel for the petitioners that the petitioners are the agnates of the informant. Though, five persons received injuries from the informant's side but all the injuries have been found to be simple superficial in nature. It is
Patna High Court Cr.Misc. No.25562 of 2015 (2) dt.01-07-2015 2/2 further submitted accusation has been levelled when Title Suit No. 239 of 2008 was decided in favour of the petitioners and earlier also the informant's side lodged Itarhi P.S. Cae No. 05 of 2008 which was found false and the prosecution recommended for proceeding Under Section 182/211 IPC against the informant. There is counter version of the occurrence also and petitioners' side also received injuries.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Itarhi P.S. Case No. 82 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
