In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 376/34 of the I.P.C.

At the very out set it has been submitted that in this case after completing investigation against the petitioners the case has not been found true and accordingly they had not been sent up for trial. Charge-sheet has been submitted only against Bishwa Nut and moreover now the informant has filed compromise petition vide Annexure-3 with a prayer to grant permission to compromise the case. Accordingly, it is submitted that the petitioners deserve sympathetic consideration, to which the

Patna High Court Cr.Misc. No.31342 of 2014 (2) dt.30-01-2015 2/2 learned A.P.P. fairly submits that in this case the Police after completing investigation has submitted final form against the petitioners.

In the facts and circumstances as stated above, the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Buxar in Simri P.S. Case No. 58 of 2012, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
