Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Amresh Kumar Sinha, Advocate For the Opposite Party/s : Mr. Md. Ashlam Ansari, APP ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody on his remand on 23.02.2018 in connection with Kotwali (Barari) P.S. Case No.84 of 2018 registered for the offence under Sections 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that once the petitioner has been arrested in connection with Barari P.S. Case No.306 of 2015 and produced before the court on 16.01.2018, there was no question of recall of the order of warrant of arrest as the petitioner had already been taken into custody. Thus, the allegation made that the petitioner had

Patna High Court Cr.Misc. No.32421 of 2018 (3) dt.28-06-2018 2/2 manufactured a fake order of recall from the court is wholly improbable and ridiculous.

Having considered the entire facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Barari) P.S. Case No.84 of 2018. (Anjana Mishra, J) PNM U T
