Petitioners apprehend their arrest in connection with Muffasil (Lakhaura) P.S. Case No. 13 of 2014 registered under Sections-447, 341, 323, 324, 307, 380, 504, 506/34 of the Indian Penal Code.
Admittedly, co-accused Birendra Prasad and petitioner No. 1 are full brothers of the informant of the present case and so far as petitioner Nos. 2 & 3 are concerned; they are nephew of the informant. Moreover, there is no specific allegation of assault against these petitioners and it is also an admitted
Patna High Court Cr.Misc. No.32103 of 2014 (2) dt.03-02-2015 2/2 position that for the occurrence of same day, co-accused, Birendra Prasad lodged Muffasil ( Lakhaura) P.S. Case No. 14 of 2014 against the prosecution party.
Taking into consideration the above-said facts and circumstances as well as submission of the parties, let the petitioners named above, in the event of arrest or surrender in the court below within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Muffasil (Lakhaura) P.S. Case No. 13 of 2014 P.S. Case No. 13 of 2014 to the satisfaction of Sub Divisional Judicial Magistrate, Sadar, Motihari, District-East Champaram subject to conditions as laid down u/S 438(2) of the Cr. P.C.
