The petitioner, who is in custody, seeks bail in connection with Patahi P.S. Case No. 99 of 2017 registered for the offence punishable under Sections 354(B), 376, 511 of the Indian Penal Code and Section 4/8 of POCSO Act, 2012. The allegation against the petitioner is of outraging modesty of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to previous enmity between the parties. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 19.08.2017.
Patna High Court Cr.Misc. No.45044 of 2017 (2) dt.21-09-2017 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Session Judge-Cum-Special Judge, POCSO Act, East Champaran, Motihari, in connection with Patahi P.S. Case No. 99 of 2017.
