The petitioner apprehends his arrest in Khagaria (Gangaur) P. S. Case No. 503 of 2013, G. R. No. 1756 of 2013 for the offence punishable under Sections 498- A/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act. It is submitted that the petitioner has no criminal antecedent.

This petition stands disposed of with a liberty to the petitioner to move before the learned Sub-dividisonal Judicial Magistrate, Khagaria/court concerned who will pass the order in view of the direction given by the Hon'ble Supreme Court in the

Patna High Court Cr.Misc. No.32505 of 2014 (2) dt.02-02-2015 2/2 case of Arnesh Kumar vs. State of Bihar & Anr., reported in 2014(3) PLJR 314 (SC).

It will be open to the petitioner to move before the leaned Sub-divisional Judicial Magistrate along with the judgment of Hon'ble Suprme Court.
