The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 396, 120B and 412 of the Indian Penal Code.

It is alleged that the miscreants while snatching money bag from the brother of the informant shot fire on 10.01.2005 leading to registration the FIR against unknown. On conclusion of the investigation, the petitioner was not sent up for trial but differing with the Final Form learned ACJM took cognizance on 24.03.2011 against the petitioner also under sections 396, 120B, 412 of the of the Indian Penal Code. It is submitted by learned counsel for the petitioner that the petitioner could prefer anticipatory bail before since no notice was circulated upon the petitioner.

Patna High Court Cr.Misc. No.21282 of 2015 (2) dt.20-05-2015 2/2 Considering the fact that the petitioner was not sent up for trial, it is a fit case for consideration of regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Dalsinghsari P.S. Case No.2 of 2005, pending before the ACJM, Dalsingsarai, Samastipur.

With the above observation, this application is, accordingly, disposed off.
