Case No. 262 of 2019 dated 21.07.2019 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

Two persons were spotted unloading cartons of liquor in the house of the petitioner. On seeing the police party, the miscreants fled away. However, they were identified by a local Chowkidar as the petitioner and one Suresh Yadav.

It has been submitted on behalf of the petitioner that 103.125 litres of liquor has been

Patna High Court CR. MISC. No.16395 of 2020(2) dt.13-05-2020 2/2 recovered from the hut of the petitioner. The petitioner denies that any such recovery was made from his house. It has also been submitted that the recovery is from a place which is accessible from all sides. The petitioner is stated to be in custody since 24.01.2020.

Considering the afore-stated facts, The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II cum Special Judge, Excise Act, Sitamarhi in connection with Nanpur P. S. Case No. 262 of 2019.
