The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 498(A), 354 and other allied sections of the Indian Penal Code. As per the FIR, petitioners along with co-accused persons subjected the informant to mental and physical torture for dowry. It is further alleged that the accused persons assaulted and ousted her from matrimonial house due to non-fulfillment of demand of dowry.

It is submitted that petitioner no. 1 is father-in-law

Patna High Court CR. MISC. No.17556 of 2022(2) dt.27-09-2022 2/2 and petitioner no. 2 is brother-in-law (Dewar) of the informant and they have been falsely implicated in this case. There is general and omnibus allegation. Thrust of accusation is against husband of the informant. Petitioners are separate in mess and property and have got no concern with the family affairs of the informant and her husband. Petitioners claim clean antecedent. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Madhubani in connection with Rajnagar P.S. Case No. 09 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
