Petitioner, already in custody, seeks bail in connection with Narhat P.S. Case No.66 of 2018, registered under Sections 341, 323, 307, 452, 448, 504, 376 and 511 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that on previous day the informant's husband had gone in the field to attend the call of nature then this petitioner opened three rounds of firing but missed the target and on the next day in the night, all accused persons entered in the house and made an attempt to rape the informant but on alarm raised by the informant, the accused persons escaped away.
Learned counsel for the petitioner submits that both
Patna High Court Cr.Misc. No.45578 of 2018(2) dt.30-07-2018 2/2 sides are agnates, there is no injury to anyone as per the allegation itself and the informant is made accused each family members of the petitioner including female members, even his mother-in-law was granted bail by the sessions court; whereas, other co-accused was also granted anticipatory bail by a coordinate Bench of this court vide order dated 12.06.2018, passed in Cr. Misc. No.31396 of 2018 and this petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioner Suresh Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Narhat P.S. Case No.66 of 2018.
