JUSTICE SATYAVRAT VERMA ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.12.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 950 litres of liquor from a Tata 407 vehicle.

Learned counsel for the petitioner submits that the vehicle does not belong to the petitioner rather he is alleged to be the driver as such the petitioner was not knowing what the owner had kept in the vehicle.

Patna High Court CR. MISC. No.16723 of 2022(2) dt.08-04-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Aurangabad Muffasil P.S. Case No. 319 of 2021.
