Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Kumarkhand (Belari O.P.) P.S. Case No. 220 of 2017, registered for offences alleged under Sections 461 and 379 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner has been taken on remand in the present case when he was arrested in connection with Saharsa Sadar P.S. Case No. 1157 of 2017. He has further been granted bail in the said case. So far as the present case is concerned, it is submitted that the petitioner is

Patna High Court Cr.Misc. No.32468 of 2018 (2) dt.13-06-2018 not named and no stolen articles have been recovered from his possession. The petitioner has been implicated in this case only on mere suspicion without there being any substantial reason for the same.

Learned APP for the State is present and has opposed the prayer for the bail.

Considering the facts and circumstances of the case whereunder the petitioner is not said to be named in the F.I.R. and no stolen article has been recovered from his possession, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Kumarkhand (Belari O.P.) P.S. Case No. 220 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
