JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Singheshwar P.S. Case No.01 of 2013, disclosing offences under Section 7 of the Essential Commodities Act.
The petitioner is the owner of a flour mill.
Certain bags of wheat were seized from a vehicle, whereafter, the First Information Report came to be
Patna High Court Cr.Misc. No.19449 of 2016 (2) dt.19-05-2016 2/3 instituted with a suspicion that the wheat was to be sold in black-market.
Learned counsel for the petitioner has submitted that co-accused, namely, Sonu Kumar Bhagat, who claimed his ownership over the said bags of wheat, has been granted anticipatory bail by this Court vide order, dated 08.08.2013, passed in Cr. Misc. No.20633 of 2013.
It has been stated in paragraph 3 of the application that petitioner has no criminal antecedent. Considering the above, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhepura, in connection with Singheshwar P.S. Case No.01 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the
Patna High Court Cr.Misc. No.19449 of 2016 (2) dt.19-05-2016 3/3 event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
