The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that while his brother along with one another was returning home on a motorcycle, the six named accused persons including the petitioner herein as also 25-30 others raised a hulla of them being thief and started to assault them with bricks, stones, danda etc seriously injuring them. The brother of the informant died while his friend was undergoing treatment. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The

Patna High Court CR. MISC. No.26663 of 2021(3) dt.03-01-2022 2/2 allegations are general and omnibus in nature. The petitioner is in custody since 18.12.2020 and charge sheet has been submitted in the case. He has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the manner of occurrence and the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Sadar (Sonki O.P) P.S. Case no. 382 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga.
