The petitioner apprehends his arrest in a case registered for the offence under Section 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Total 19.5 liters of Nepali liquor has been recovered from the house of this petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been effected from the roof and straw house of the petitioner and house in question is in joint possession of the family. Petitioner has got no concern with the alleged liquor. Petitioner claims clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.16352 of 2023(4) dt.24-07-2023 2/2 from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum Special Judge, Excise Act, Madhubani in connection with Bisfi (Patauna O.P.) P.S. Case No. 26 of 2023, corresponding to G.R. No. 159 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
