19-09-2017 Heard Sri Amresh Kumar Sinha, learned counsel for the petitioner and Sri Shailendra Kumar Singh, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 03-08-2017 in Warsaliganj P.S. Case No. 167 of 2017 registered for offence under Sections 120(B)/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail on the ground of parity.

Learned counsel for the petitioner submits that other four accused persons, in similar circumstances, have already been granted bail by this Court on 19-08-2017, vide Cr. Misc. No. 39175 of 2017. Learned counsel for the petitioner has also drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent.

Patna High Court Cr.Misc. No.43069 of 2017(2) dt.19-09-2017 2/2 Considering the nature of accusation, clean antecedent, period of custody as well as the fact that other four accused have been granted bail, there is no reason to deny the prayer of petitioner.

Accordingly, let the petitioner namely Sanjit Singh @ Rinku Singh @ Rinku Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum Special Judge, Nawada in connection with Warsaliganj P.S. Case No. 167 of 2017.
