The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 386, 387/34 of the Indian Penal Code and section 17 of the C.L.A. Act.
Accusation is demand of extortion through mobile and during investigation some of the persons suggested name of the petitioner.
It is submitted by learned counsel for the petitioner that the mobile used for the purpose of extortion is not registered in the name of the petitioner and only on confession of co-accused due to rivalry, the petitioner being Mahanth of Ram Janki Thakurbari Math has been roped in the present case.
Patna High Court Cr.Misc. No.21291 of 2015 (2) dt.20-05-2015 2/2 It is submitted by learned counsel for the informant that the petitioner has serious criminal antecedent. Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Dumariyaghat P.S. Case No.7 of 2014, pending before learned Chief Judicial Magistrate, Motihari, East Champaran.
With the above observation, this application is, accordingly, disposed off.
