25-06-2018 Heard Sri Aditya Narayan Singh, learned counsel assisted by Sri Pramod Kumar, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody since 23-04-2018 in Gautam Budh Nagar P.S. Case No. 111 of 2018 registered for offence under Sections 147, 148, 149, 323, 188, 504, 506 of the Indian Penal Code and later on Sections 3 & 4 of Explosive Substances Act, 1908 were added, have prayed for grant of bail.
Learned counsel for the petitioners, by way of referring to F.I.R., submits that it appears that color of serious offence has been given in a case, in which, there is actually allegation of violation of proceedings under Section 144 of the
Patna High Court Cr.Misc. No.33799 of 2018(2) dt.25-06-2018 2/2 Code of Criminal Procedure, 1973.
Besides hearing, I have also perused the F.I.R. and after going through the same, the Court is of the opinion that it is a fit case for extending the privilege of bail. Accordingly, let both the petitioners namely Pappu Tiwary and Sanjay Tiwary be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with G.B.Nagar P.S. Case No. 111 of 2018.
