The petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No.320 of 2005 registered under Section 47(A) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from outside of the house of the petitioner. The petitioner has no concern with the alleged liquor or the place of recovery.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.18053 of 2023(2) dt.05-05-2023 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-IV-cum-Special Judge (Excise), Lakhisarai in connection with Lakhisarai P.S. Case No.320 of 2005 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
